Hi there. We are sorry that you have found yourself a victim of gazumping. Unfortunately until contracts are exchanged there is nothing to prevent a seller accepting another offer. It seems to me that you have been involved in a contract race. There are strict rules governing solicitors in this situation - whilst there is nothing to stop a seller issuing more than one contract the Law Society requires the seller's solicitor to notify all parties to whom a contract has been issued that they are in a contract race and to explain the terms of the race. It sounds as if your prospective seller's solicitor has not done that in this case and it may be worth discussing with your solicitor whether there are any grounds for complaint. You won't secure the property you wanted but it may be some consolation.

If the vendor has been disengenuos and caused you a loss of money by not informing you that you were not the sole prospective purchaser, even though you only proceeded at their request, then you've a case in small claims because it's not reasonable and you did everything asked of you. IMO.

I was a solicitor for 25 years before setting up No-flies and unfortunately the facts that you set out maroberts82 do not IMO give you any right of action against the seller, whether in the small claims court or elsewhere. I am not in the business of giving legal advice these days however so you may want to confirm that with your solicitor. Hope that helps.

    • That’s another big hike on the Sainsbury’s mini rolls! I spoke to one of the managers on the day of the anchovies price rise but all he could say was that his store doesn’t set the prices. Very vague and not helpful. i started this thread about price rises in  Sainsbury’s and it’s somehow being blamed on Brexit etc! 
    • And the Sainsbury’s own brand chocolate mini rolls have gone from £1.15 to £1.40 overnight, so 22%-ish. I prefer them them to the Cadbury original because they have a lot more chocolate on them, presumably because they’re made in a less advanced factory. I would think that getting the Rizla thin coating of chocolate that Cadbury’s accountants demand onto a piece of sponge is quite a sophisticated operation. Discuss.
    • Another recommendation for Leon. He was able to come out to our electrical elergency within 24 hours of me contacting him. His communication was great and whilst he could not solve our problem, he was able to perform tests to identify this and did so quickly and efficiently.
