Hello,

Need some advice re. subsidence


Has anyone in E. Dulwich had experience getting a neighbor to remove a large tree from their garden which has been proved to be the cause of subsidence in other adjacent properties? Does this need to go through the council or should I let my home insurance company's loss prevention firm to address this directly with them? Thanks for any feedback on this topic.

It needs to go to the Land Registry to find the owner of the tree.

You will need to get permission to remove the tree.


I went through this proceedure 20 years ago.


The tree was on a shared access which was not part of access to my property.

and did not affect my property, but I still ending up paying for some of the work.


Very complex proceedure.

I had exactly this problem in a previous property.


The insurance company's loss prevention guys determined that the tree was causing a problem, and they then contacted the neighbours directly to arrange removal. Contrary to DulwichFox's experience, it was all resolved very easily.

Thanks all for the feedback. I spoke to the council tree specialist today and he said they could not do anything as its a private property. Peckhampam, was your's a council property or private?


I was told I could prune any overhanging branches but as per law would have to offer them to the owner - who can accept or not. If not, I am responsible for disposing of them. Got to love that law.


As to the greater problem, I was advised I would need to address this with the owner of the property who could agree or not to take down the tree. If they don't agree, I would need to look to my insurance company to file a law suit against them which could take years. I am now siding with DulwichFox's experience!

    • In the park this morning I spoke to one of the workers who's been there years, he told me there is a cherry tree which is diseased which is due for removal,  but it is in the wooded area. So it seems there is confusion over which cherry tree? So I think we do need to keep our eyes on what is happening in the park and question things that don't seem right and contact either FoPRP, the park manager or our councillors to make sure mistakes don't happen.
