The Dulwich Estate who owns the freehold to the school grounds, intends to develop the green space playground at Judith Kerr Primary School for its subsidiary, the Dulwich Almshouse Charity. It aims to relocate the current almshouses situated in the centre of Dulwich Village with a new development of assisted living accommodation for up to 20 elderly residents on the school grounds. If this development goes ahead, the 350 schoolchildren would as a result lose 2/3 of their already tight outdoor play and sports space and all of the school?s usable green space. We encourage you to attend one of these events to register your opposition to the proposals. The events will take place on: Wednesday 8th June from 4pm to 7:30 and on Saturday 11th June from 2pm to 4pm at the Methodist Church on Half Moon Lane, opposite the school. The Greenspace Campaign is led by parents of children at JKPS and fully supports the Dulwich Almshouse Charity?s need for new accommodation. The Dulwich Estate is a substantial local landowner and able to find an alternative, more suitable site. Taking away 2/3 of a local state school?s outside space, which is currently used extensively for play, sport and education, is not an acceptable solution. Southwark Council have published their New Southwark Plan preferred option which states that the green space (playing field) at Judith Kerr Primary School should be designated ?Open Space? status. The proposed designation to ?Open Space? in the New Southwark Plan will help protect it from the current threat of development by The Dulwich Estate. JKPS is a state primary school and leases its building and grounds, which includes the green space, from The Dulwich Estate. The Dulwich Estate incorporated an option into the lease allowing it to develop residential housing on the green space subject to planning permission. If the development is approved, the green space will be permanently lost to the school. This will remove the school's only playing field, will reduce the outside space available by more than half, and remove all green space. This will severely restrict opportunities for education, play and sport for generations of children. Any development will add congestion to a very busy intersection and its proximity to the school gates will constitute an ongoing safety risk. Legalalien- the site and lease were negotiated between the Dept of Education and Dulwich Estate - not JKPS. However you look at it, the local community, school and children will surely be best served if the school keeps the playing field. Please sign the petition!

The advice from the Secretary of State for Education is emphatically in favour of protecting school playing fields: https://www.gov.uk/government/publications/protection-of-school-playing-fields-and-public-land-advice. The Dulwich Estate?s plan to deprive JKPS of its only playing field is contrary to government policy of safeguarding playing fields. The Dulwich Estate is primarily an education charity. Its charitable objective is to raise money for its beneficiaries, which are predominantly private schools with extensive grounds and excellent sporting facilities. JKPS is a state school which is run by an education charity, CfBT. It is inequitable for The Dulwich Estate, as an educational charity, to generate revenue for its affluent beneficiaries by disposing of another school?s playing field; all the more so where that school is run by an education charity. It will also severely hinder CfBT from achieving its stated mission to ?advance education for the public benefit?. The Dulwich Estate?s plan to develop the playing field for commercial gain therefore deviates from its duty to carry out its charitable purposes for the 'public benefit' (as defined in the Charities Act 2011). Why is the JKPS Green Space Campaign and not the school campaigning to keep the playing field? The lease from The Dulwich Estate stipulates that JKPS is not allowed to object to planning permission. Therefore the JKPS Green Space Campaign has been established to prevent the school from losing the playing field on behalf of the school, its children and the local community. The lease further restricts the school, CfBT and the school?s governing body from opposing the planning application(s). We consider that The Dulwich Estate, as an education charity, is actively preventing JKPS from promoting the best interests of its children and campaigning to keep the green space for the school. This again is contrary to the Charity Commission?s requirement for The Dulwich Estate to pursue its charitable purpose for the ?public benefit?. As some of you may be aware, Southwark Council is consulting on its New Southwark Plan (the "Plan") to manage regeneration and development from 2018 - 2033. Here is a link to the Plan Options Paper for further background: www.southwark.gov.uk/newsouthwarkplan The Plan is particularly concerned with new housing provision in Southwark. It identifies sites which may potentially be developed for housing (or other amenities). Among the sites is the Judith Kerr Primary School. We understand that the School has been included in the Plan because the owner of the freehold, Dulwich Estate, has ambitions to develop the green space east of the School building for residential housing. The green space is part of the fabric of the School. It allows our children to escape the pressures of the classroom, and enjoy sports and recreation. The green space is also home to an embryonic organic vegetable patch which will have an educational benefit as well as being open to the local community. Ultimately, we will attempt to designate the green space as a "Local Green Space" and thereby preserve it for use by the School. We ask the community to oppose the development of the green space for the benefit of the school children and for future generations. We therefore urge you to contact [email protected] no later than Friday 6th March, and register your objection to the inclusion of the School in the Plan as a site for potential housing development.
